1. Who we are

Redmont & Co. is a brand operated by MoonHero LLC ("we", "us", "our"). These Terms of Service govern your access to and use of redmontandco.com and any purchase you make through it.

By visiting our site or placing an order, you agree to these terms. If you do not agree, please do not use the site.

2. Eligibility

You must be at least the age of majority in your state or province of residence to purchase from this site. By placing an order you confirm that you meet this requirement and that the payment method you use is your own or that you are authorised to use it.

3. Orders and acceptance

Your order is an offer to buy. It is accepted only when we send you a shipping confirmation email. Our order confirmation email acknowledges that we received your order; it is not acceptance.

We may refuse or cancel any order, in whole or in part, at our discretion. Reasons include suspected fraud, an unauthorised payment method, a shipping address we cannot serve, quantities that appear intended for resale, or an error in the price or description of a product.

If we cancel an order after you have paid, we will refund you in full to your original payment method.

4. Pricing and errors

Prices are shown in US dollars and may change at any time without notice. Prices displayed at the time you order apply to that order.

Despite our efforts, our site may occasionally contain errors in pricing, description, availability or imagery. We reserve the right to correct any error and to cancel an affected order even after it has been confirmed, including after payment. If we cancel for this reason, we refund you in full.

5. Products and imagery

Product photography on this site is digitally created and is intended to represent the item you will receive as accurately as possible. Colours, finish and texture may appear differently on your screen and may vary slightly from the item delivered.

Product dimensions and capacities are approximate and given as a guide. The materials used in each product are described on its product page. The Skyline Backpack is made from polyurethane, a synthetic material, and is not animal leather.

Natural materials vary between individual pieces in colour, grain and finish. This is a characteristic of the material and not a defect.

Availability is not guaranteed and we may discontinue any product at any time.

6. Payment

Payment is taken at checkout. We accept the methods shown at checkout. You are responsible for any charge your bank or card issuer applies, including foreign transaction fees.

Charges from this store may appear on your statement as REDMONTANDCO.

7. Shipping and delivery

Products are shipped from suppliers located outside the United States unless a product page states otherwise.

Delivery estimates given on product pages, at checkout and in our Shipping Policy are estimates, not guarantees. They are not part of any contract between us. Carrier delays, customs processing, weather and events outside our control can extend them. We are not liable for delays that arise from these causes.

Risk of loss and title pass to you when the carrier delivers the package to the address you provided. You are responsible for entering a correct and complete delivery address. We are not responsible for orders delivered to an incorrect address you supplied, or for packages stolen after confirmed delivery, though we will help you pursue a claim with the carrier where we can.

8. Duties and taxes

Sales tax is applied where required. Where import duties or taxes apply to an order, the treatment is described in our Shipping Policy. Any duty or tax you are asked to pay directly by a carrier or customs authority is your responsibility and is not refundable by us.

9. Returns and refunds

Returns and refunds are governed by our Refund Policy, which forms part of these terms and is available at redmontandco.com/policies/refund-policy.

10. Reviews, feedback and submissions

If you send us reviews, photographs, suggestions or other material, whether at our request or unprompted, you grant us a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce, modify and publish that material in any medium, without payment or attribution.

You are responsible for what you submit. You agree not to submit material that is unlawful, defamatory, obscene, infringes anyone's rights, or that impersonates another person. We may edit or remove any submission at our discretion, and we are under no obligation to publish or retain anything you send.

11. Acceptable use

You may not use this site for any unlawful purpose, to solicit others to unlawful acts, to infringe our or anyone else's intellectual property, to harass or abuse others, to submit false information, to upload malicious code, to scrape or harvest data, to interfere with the security of the site, or to attempt to gain unauthorised access to any part of it.

We may terminate your access for breach of this section.

12. Intellectual property

The site, its design, text, graphics, imagery, and the Redmont & Co. name and marks are owned by MoonHero LLC or licensed to us and are protected by intellectual property law. You may not copy, reproduce or use them without our written permission, other than for your own personal, non-commercial use of the site.

13. Third-party links and services

Our site may link to or rely on third-party sites and services, including payment processors, shipping carriers and suppliers. We are not responsible for their content, policies or practices, and their inclusion does not imply endorsement. Complaints or claims regarding a third-party product or service should be directed to that third party.

14. Disclaimer of warranties

The site and everything on it is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

We do not warrant that the site will be uninterrupted, secure or error free, or that any information on it is accurate, complete or current.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing here limits any right you have under applicable consumer protection law that cannot be waived.

15. Limitation of liability

To the fullest extent permitted by law, MoonHero LLC and its officers, employees and agents will not be liable for any indirect, incidental, punitive, special or consequential damages, including lost profits, lost data, or loss of use, arising from your use of the site or from any product purchased through it.

Where liability cannot be excluded, our total liability to you for any claim is limited to the amount you paid for the product giving rise to the claim.

16. Indemnity

You agree to indemnify and hold harmless MoonHero LLC from any claim or demand, including reasonable legal fees, arising from your breach of these terms or your violation of any law or the rights of a third party.

17. Governing law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in San Francisco County, California, and you consent to their jurisdiction.

Before filing any claim, you agree to contact us at support@moonhero.app and give us thirty days to resolve the matter informally. Most problems are settled this way.

18. General

If any provision of these terms is found unenforceable, that provision is severed and the rest remains in effect. Our failure to enforce any right is not a waiver of it.

These terms, together with our Refund Policy, Shipping Policy and Privacy Policy, are the entire agreement between us and supersede any prior communications.

We may update these terms at any time by posting a revised version on this page. Changes take effect when posted. Your continued use of the site after that constitutes acceptance. Orders are governed by the terms in effect when the order was placed.
